
Batam, gokepri – The Ministry of Marine Affairs and Fisheries (KKP) has sealed the luxurious Pulau Bawah Resort and tourist destination in Anambas Regency, Riau Islands. The company was found to be operating without a permit to use marine space, coastal areas, and small islands.
The closure is a follow-up to the findings of the Supreme Audit Agency (BPK) on PT Pulau Bawah (PB), which is suspected of exploiting small islands in violation of applicable rules.
Director-General of Marine and Fisheries Resource Supervision (PSDKP), Laksda TNI Adin Nurawaluddin explained that PT PB is suspected of exploiting small islands without having the necessary four permits, namely the document of approval for the conformity of marine space utilization activities (PKKPRL), business permits, permits for the utilization of small islands in the context of foreign investment, and permits for natural marine tourism in conservation areas.
“Based on the inspection report, PT PB was found to have violated the use of small islands because it did not have the PKKPRL document, business permits, permits for the utilization of small islands, and permits for the utilization of conservation areas. Therefore, on Friday (10/3), KKP forcibly temporarily halted all activities of PT PB in Anambas Regency,” said Adin from a statement received in Batam, Saturday, March 11, 2023.
Before the closure, KKP had issued two warning letters to PT BP in mid-2022. However, since there was no intention to resolve the determined permits, KKP then called back PT PB’s management.
Adin stressed that PT PB was subject to administrative sanctions based on Article 18 Number 28 jo Number 29 of Government Regulation Number 2 of 2022 concerning Job Creation and Article 3 jo Article 4 jo Article 7 paragraph (1) letter b and paragraph (2) letter c of the Minister of Marine Affairs and Fisheries Regulation Number 31 of 2021 concerning the Imposition of Administrative Sanctions in the Field of Marine and Fisheries. This sanction is in the form of government coercion or temporary cessation of activities.
“According to the direction of Marine Affairs and Fisheries Minister Sakti Wahyu Trenggono, the utilization of marine space must be carried out in accordance with applicable rules, so as not to cause ecological damage, as stated in the Minister of Marine Affairs and Fisheries Regulation Number 53 of 2020 concerning the Management of Permits for the Utilization of PPK in the Context of Foreign Investment (PMA),” explained Adin.
PT PB’s operations will be temporarily halted until it can fulfill the licensing obligations in accordance with applicable rules in carrying out business activities.
